Hong Kong mainland divorce: one family, two legal systems
Thousands of families live across the Shenzhen–Hong Kong boundary: one spouse working in Hong Kong, a flat in Nanshan, children crossing daily to school, bank accounts on both sides. When a relationship ends, a Hong Kong mainland divorce raises questions neither system answers alone. Which court should hear the case? Will a Hong Kong order work in Shenzhen? What happens to property on the other side?
Since 15 February 2022, the Arrangement on Reciprocal Recognition and Enforcement of Civil Judgments in Matrimonial and Family Cases between the Mainland and Hong Kong has made this much more workable. This page explains how it operates and how we help.
A note on our role: Choi & Huang is a mainland China law firm. We advise on mainland law and mainland courts, and we work alongside Hong Kong solicitors and barristers for the Hong Kong-law aspects of your case.
The 2022 Arrangement in brief
The Arrangement allows judgments and orders in family matters made in one place to be recognised and enforced in the other. In general terms it covers:
- Divorce judgments and, on the mainland side, divorce certificates issued by marriage registries
- Custody, access and guardianship orders
- Maintenance and child support orders
- Matrimonial property orders
- Certain other family orders, such as some protection-related orders
On the mainland, applications to recognise a Hong Kong order go to the Intermediate People's Court. In Hong Kong, applications go to the Hong Kong courts under local procedure. For more background see our article on Hong Kong–mainland divorce recognition and the glossary entry on the Hong Kong–Mainland Arrangement.
Choosing the forum: Hong Kong or the mainland?
Where both courts could hear the case, the choice can affect speed, cost and outcome. Factors we look at with you include:
- Where each spouse and the children live, and where they are likely to live
- Where the main assets are — a Hong Kong flat and MPF, or a Shenzhen apartment and a mainland company
- Grounds for divorce and procedure — the mainland applies Chinese law in court divorces, with court mediation first; Hong Kong has its own grounds and procedure
- Approach to property and maintenance, which differs between the two systems
- Timing and cost, including whether one party is likely to delay
- Enforcement — an order is only as good as your ability to use it where the assets or the other parent are
Timing can also matter: once one court has accepted a case, starting parallel proceedings on the other side may be refused or create conflicting orders, so it pays to take advice early.
Our article on divorcing in China or abroad walks through the general thinking. Because the answer depends on both systems, we often give this advice together with your Hong Kong solicitor.
Using Hong Kong orders on the mainland, and mainland orders in Hong Kong
Hong Kong to the mainland
If you divorced in Hong Kong and need to remarry, sell property or enforce maintenance on the mainland, we prepare and file the recognition application at the relevant Intermediate People's Court, including certified copies, proof the order is effective and translations where required.
Mainland to Hong Kong
A mainland divorce judgment, mediation statement or registry divorce certificate can generally be recognised in Hong Kong under the Arrangement. We prepare the mainland-side documents and certifications, and your Hong Kong solicitor handles the local application.
Cross-boundary children
Children who live in Shenzhen and study in Hong Kong, or the reverse, need arrangements that work in practice: school runs across the boundary, travel documents, holidays and decision-making. Custody decisions on the mainland follow the child's best interests (Civil Code Art. 1084), and both parents keep parental rights and duties after divorce. We help draft clear parenting plans and, where needed, seek orders that can be recognised on both sides. See our child custody service.
Property on both sides of the boundary
Real estate in mainland China is registered and transferred under mainland rules; Hong Kong property follows Hong Kong law. A settlement or order that ignores this can be hard to implement. We coordinate so that transfer documents, tax filings and registrations are ready on both sides.

Frequently asked questions
Is a Hong Kong divorce recognised in mainland China?
It can be. Under the Mainland–Hong Kong Arrangement in force since 15 February 2022, a Hong Kong divorce order can be recognised by applying to a mainland Intermediate People's Court. You generally need recognition before remarrying or dealing with property on the mainland.
Can a mainland Chinese divorce certificate be used in Hong Kong?
Generally yes. The Arrangement allows divorce certificates issued by mainland marriage registries, as well as mainland court judgments, to be recognised in Hong Kong. The application is made in Hong Kong, usually through a Hong Kong solicitor.
Should I file for divorce in Hong Kong or Shenzhen?
It depends on where you and the children live, where the assets are, and how each system treats property and maintenance. Because the answer involves both systems, it is best assessed by mainland and Hong Kong lawyers together before either party files.
Does the Arrangement cover child custody and maintenance?
Yes. In general terms it covers custody, access and guardianship orders as well as maintenance and child support orders, alongside divorce and matrimonial property orders.
Are you Hong Kong lawyers?
No. Choi & Huang is a mainland China law firm based in Shenzhen and Guangzhou. We advise on mainland law and courts and work with Hong Kong solicitors and barristers on the Hong Kong-law side of your case.
