We help foreign managers, engineers and factory owners in Dongguan — and their spouses and children — with divorce, custody and property matters. We have no office in Dongguan and serve clients from our Shenzhen office and by video, meeting locally when needed.
Family law in DongguanWhich court handles it in Dongguan?
Divorce, custody and support cases are generally heard first by the basic people's court covering the town or subdistrict where the defendant is domiciled. Because Dongguan has no county-level districts, basic courts cover groups of towns and subdistricts rather than districts — we confirm the correct court for your address. If the defendant lives outside mainland China, the court of the plaintiff's domicile can often hear a divorce.
Recognition of foreign divorce judgments and Hong Kong–Mainland arrangement applications go to the Dongguan Intermediate People's Court, which also hears appeals.
Marriage & divorce registry in Dongguan
Marriage and agreed-divorce registration is handled by marriage registries under the Dongguan Civil Affairs Bureau. Registrations involving a foreign national can only be handled at a designated registry, and both parties must attend in person. Designated offices, appointment rules and document lists change from time to time, so check the current position before you go — or ask us to check for you. Since 10 May 2025, registration is nationwide: where one partner is a mainland resident, you can use any registry authorised for foreign-related matters anywhere in China, not only one in your hukou city, and the Chinese partner needs only a resident ID card and a signed declaration (no hukou booklet).

Hong Kong mainland divorce: one family, two legal systems
Thousands of families live across the Shenzhen–Hong Kong boundary: one spouse working in Hong Kong, a flat in Nanshan, children crossing daily to school, bank accounts on both sides. When a relationship ends, a Hong Kong mainland divorce raises questions neither system answers alone. Which court should hear the case? Will a Hong Kong order work in Shenzhen? What happens to property on the other side?
Since 15 February 2022, the Arrangement on Reciprocal Recognition and Enforcement of Civil Judgments in Matrimonial and Family Cases between the Mainland and Hong Kong has made this much more workable. This page explains how it operates and how we help.
A note on our role: Choi & Huang is a mainland China law firm. We advise on mainland law and mainland courts, and we work alongside Hong Kong solicitors and barristers for the Hong Kong-law aspects of your case.
The 2022 Arrangement in brief
The Arrangement allows judgments and orders in family matters made in one place to be recognised and enforced in the other. In general terms it covers:
- Divorce judgments and, on the mainland side, divorce certificates issued by marriage registries
- Custody, access and guardianship orders
- Maintenance and child support orders
- Matrimonial property orders
- Certain other family orders, such as some protection-related orders
On the mainland, applications to recognise a Hong Kong order go to the Intermediate People's Court. In Hong Kong, applications go to the Hong Kong courts under local procedure. Hong Kong–Mainland Cross-Border Family Matters in Dongguan: FAQs
Do I need to meet a lawyer in person in Dongguan for hong kong–mainland cross-border family matters?
No. We don't have an office in Dongguan; clients there are looked after by our Shenzhen team by video, phone, WeChat or WhatsApp, and we meet locally or attend Dongguan courts and registries in person whenever the case requires it.
Do you have an office in Dongguan?
No. We serve Dongguan clients from our Shenzhen office and by video, and our lawyers travel to Dongguan for meetings or hearings when needed. Most of the work can be done remotely.
My spouse owns a factory in Dongguan. Is the business part of our marital property?
It depends on when and how the business was acquired. Company shares or business income acquired during the marriage are generally community property, even if registered only in your spouse's name. Pre-marital shares are usually separate, though growth during the marriage can raise difficult questions. Valuation often needs accounting evidence.
Is a Hong Kong divorce recognised in mainland China?
It can be. Under the Mainland–Hong Kong Arrangement in force since 15 February 2022, a Hong Kong divorce order can be recognised by applying to a mainland Intermediate People's Court. You generally need recognition before remarrying or dealing with property on the mainland.
Can a mainland Chinese divorce certificate be used in Hong Kong?
Generally yes. The Arrangement allows divorce certificates issued by mainland marriage registries, as well as mainland court judgments, to be recognised in Hong Kong. The application is made in Hong Kong, usually through a Hong Kong solicitor.
Should I file for divorce in Hong Kong or Shenzhen?
It depends on where you and the children live, where the assets are, and how each system treats property and maintenance. Because the answer involves both systems, it is best assessed by mainland and Hong Kong lawyers together before either party files.
Does the Arrangement cover child custody and maintenance?
Yes. In general terms it covers custody, access and guardianship orders as well as maintenance and child support orders, alongside divorce and matrimonial property orders.
