Family law in HuizhouWhich court handles it in Huizhou?
Divorce, custody and child-support cases are generally heard first by the basic people's court where the defendant is domiciled — Huizhou covers Huicheng and Huiyang districts and Boluo, Huidong and Longmen counties, each with its own basic court, and we confirm the right court for addresses in Daya Bay and other development areas. If the defendant lives outside mainland China, the court of the plaintiff's domicile can often hear a divorce.
Recognition of foreign divorce judgments and Hong Kong–Mainland arrangement applications go to the Huizhou Intermediate People's Court, which also hears appeals.

Hidden assets in a divorce in China: you are not powerless
It is one of the most common fears we hear: "My spouse controls the money, and I think it is disappearing." Hidden assets in a divorce in China can take many forms — cash withdrawn in small amounts, shares quietly transferred to a relative, a flat bought in a parent's name, "loans" to friends that were never real, or money parked offshore. The good news is that Chinese law gives you real tools to find assets and to stop them moving, and it penalises a spouse who cheats.
This page explains how hidden asset tracing works in a divorce in China, what courts can and cannot do, and how our lawyers and in-house forensic accountant approach it. Everything we do is by lawful means only — we never use hacking, illegal surveillance or bought personal data, because evidence obtained that way can be excluded and can expose you to liability.
Warning signs that assets are being hidden or transferred
You rarely have proof at the start. What you usually have are patterns:
- Your spouse suddenly "loses" a job, says the business is failing, or reports much lower income than your lifestyle suggests
- Large or repeated transfers to parents, siblings, friends or a new partner
- New debts you never heard of, sometimes backed by IOUs from people close to your spouse
- Company shares transferred to others, or new companies set up with nominee shareholders
- Property bought in someone else's name, or a flat sold below market value
- Cash-heavy businesses (restaurants, trading, retail) where records are thin
- Crypto-asset accounts, overseas bank accounts or foreign property you only half know about
Write these down with dates. A simple timeline is often the most useful thing you can give your lawyer.
Hidden Asset Investigation & Tracing in Huizhou: FAQs
Do I need to meet a lawyer in person in Huizhou for hidden asset investigation & tracing?
No. We don't have an office in Huizhou; clients there are looked after by our Shenzhen team by video, phone, WeChat or WhatsApp, and we meet locally or attend Huizhou courts and registries in person whenever the case requires it.
Do you have an office in Huizhou?
No. We serve Huizhou clients from our Shenzhen office and by video, and our lawyers travel to Huizhou for meetings or hearings when needed.
We are Hong Kong residents with a flat in Huizhou. Which law decides who gets it?
If you divorce in Hong Kong, the Hong Kong court may make orders about the flat, but they will need recognition on the mainland under the 2022 arrangement before the title can be changed. If you divorce in a mainland court, Chinese law applies to the divorce. Either way, changing the title of Huizhou property requires steps on the mainland.
How can I find out if my spouse is hiding assets in a divorce in China?
Start with what you lawfully have: bank statements you can access, tax records, property documents and a timeline of unusual transfers. Once proceedings begin, your lawyer can ask the court to investigate banks and registries, or apply for a lawyer's investigation order where available. Forensic accounting then links the records together.
What happens if my spouse is caught hiding marital property?
Under Article 1092 of the Civil Code, a spouse who conceals, transfers or destroys community property, or invents debts, may receive a smaller share or no share. If the conduct is discovered after the divorce, the other spouse can sue to have that property divided again.
Can I freeze my spouse's bank account during a divorce in China?
Yes, by applying to the court for property preservation, either before filing or during the case. You usually need to provide security, often through an insurer's guarantee. The court then freezes the specified accounts, property or shares until the case is resolved.
Can a Chinese court reach my spouse's assets overseas?
A Chinese court can take overseas assets into account and order disclosure, but acting against property abroad usually requires steps in that country. We coordinate with local lawyers so disclosure and, where needed, recognition or freezing orders are pursued where the assets are.
