Family law in DongguanWhich court handles it in Dongguan?
Divorce, custody and support cases are generally heard first by the basic people's court covering the town or subdistrict where the defendant is domiciled. Because Dongguan has no county-level districts, basic courts cover groups of towns and subdistricts rather than districts — we confirm the correct court for your address. If the defendant lives outside mainland China, the court of the plaintiff's domicile can often hear a divorce.
Recognition of foreign divorce judgments and Hong Kong–Mainland arrangement applications go to the Dongguan Intermediate People's Court, which also hears appeals.

What counts as domestic violence under Chinese law?
The Anti-Domestic Violence Law (in force since 2016) covers physical, psychological and other harm between family members, including:
- Hitting, kicking, strangling, restraining or other physical abuse
- Threats, intimidation, constant insults and verbal abuse
- Restricting your freedom, such as locking you in or controlling where you go
- Psychological abuse such as stalking or harassment
The law also applies to people who live together without being married. Children who witness violence are also recognised as being harmed.
Domestic Violence & Protection Orders in Dongguan: FAQs
Do I need to meet a lawyer in person in Dongguan for domestic violence & protection orders?
No. We don't have an office in Dongguan; clients there are looked after by our Shenzhen team by video, phone, WeChat or WhatsApp, and we meet locally or attend Dongguan courts and registries in person whenever the case requires it.
Do you have an office in Dongguan?
No. We serve Dongguan clients from our Shenzhen office and by video, and our lawyers travel to Dongguan for meetings or hearings when needed. Most of the work can be done remotely.
My spouse owns a factory in Dongguan. Is the business part of our marital property?
It depends on when and how the business was acquired. Company shares or business income acquired during the marriage are generally community property, even if registered only in your spouse's name. Pre-marital shares are usually separate, though growth during the marriage can raise difficult questions. Valuation often needs accounting evidence.
How do I get a protection order for domestic violence in China?
You apply to the People's Court with whatever evidence you have, such as police records, medical records or threatening messages. You do not need to file for divorce first. The court rules within 72 hours, or within 24 hours in urgent cases.
How long does a personal safety protection order last?
Up to six months. It can be extended or varied if you apply to the court, for example if the risk continues or the abuser breaches the order.
What happens if my partner breaks the protection order?
Call 110 and tell your lawyer. The court can fine or detain a person who violates a protection order, and serious violations can lead to criminal liability.
Does China's domestic violence law protect unmarried couples?
Yes. The Anti-Domestic Violence Law applies to people who live together as well as to family members, so a cohabiting partner can also apply for a protection order.
